Subpart C - Administrative Employees Administrative employees also must be compensated on the same salary basis as executive employees.
29 cfr part 541, the FLSA states that administrative employees must routinely exercise independent judgment and perform non-manual work that affects the company's management or its operations.
Federal Court Declares DOL Overtime Rules Invalid - Lexology
When the FLSA says the majority of an employee's duties must require the use of independent judgment, the U. Department of Labor qualifies that as the 29 cfr part 541 main purpose in the organization is to perform tasks that affect the direction of the company.
Just because someone's title is "administrative officer," it isn't enough to qualify under this exemption -- the exempt criteria must look at the employee's job duties in their totality. Subpart D - Professional Employees Salary basis applies 29 cfr part 541 professional employees, too.
However, the work of employees under the professional exemption must require specialized knowledge.
